The intermediary is the one who connects two or more parties in order to close a deal, without being tied to anyone of the parties by connections of collaboration, dependence or representation.
He/she has the definite job of supplying the contracting parties with all the possible information so that their wish to reach a contractual agreement is formed correctly and they are capable of evaluating the economic convenience of the transaction they intend to finalise.
The job of the real estate agency is to help the parties formulate a sale and purchase price in line with the present evaluations of the specific property being transferred.
The real estate agent must assist in a way that allows the parties to reach a contractual agreement in a conscious and informed manner, for this activity they receive a commission from both parties, from who is selling and who is buying.

Job assignment for the sale of real estate.
For the task of buying and selling you assign a Real Estate Agency to sell your property for a certain price within a certain time. The duration of the job is for a limited time and according to mutual agreements may last three, six, twelve month. Usually the task is exclusive, meaning that you cannot entrust the task of selling the same property to other agencies.
The job assignment must contain:

the duration of the appointment and possible renewal clauses
the amount payable and eventual authorised expenses
exact identification of the real estate and it’s additional features
possible minimum sales price
possible minimum conditions of payment
the description of possible mortgages, constraints and limits to the marketability of the property.

ICI (Local Property Tax)
From the tax year 2008 the main residences (properties in which the specific person has residency) and related accessories (the garage or box or undercover and open parking space, the attic, the basement) are exempt from the ICI, with exception to the properties registered in categories A1, A8 and A9. The buildings, building land and agricultural land, including those specific areas assigned to the professional activities and operations of a company and those to which production or exchange are the direct trades of the company, are subject to the town council tax on properties (ICI), according to TITLE 1of the Legislative Decree 30 of December 1992, no. 504.

Energy Certification
From 8 May 2009 Energy Certification is compulsory in every single unit of real estate in the case of:
- Buying and selling/Leasing/55% Tax Relief
as in the meaning of the L.R. (Regional Law) of 29/05/07, more restrictive standards of the Legislative Decree 311/06 acknowledgment of the governing 2002/91/EC.
The certification is valid for 10 years or until a change in the building’s HVAC system and must be implemented by a qualified person and registered at the Albo della Regione Liguria (Ligurian Regional Registries)
For the compilation of the energy certification the heating system is inspected given that there is a standard that determines certification for every type of system.
Therefore the Real Estate Agency has the job of informing the parties of the new energy standards in order to gain an Energy Certification for the specific unit of real estate to be contracted for buying and selling or leasing. |
